Enduring Power of Attorney

The Enduring Power of Attorney was superseeded by the Lasting Power of Attorney (LPA). This might appear a semantic change of nomenclature, but it is more a reflection of a change in the relevant legislation and improvements to the power of attorney regieme.

While Enduring Power of Attorney documents are valid and unregistered EPA can be registered, it would be impossible to obtain a new Enduring Power of Attorney.  Donors who currently have the mental capacity are advised to obtain the Lasting Power of Attorney as the protection offered both to the donor and attorneys by the new version of this document by the nature of the enabling legislation are superior and more comprehensive.
